Procedures For Disqualification of Consultants

DISTRIBUTION: DOTD Administrators and the Consultant Community

SUBJECT: Procedures for Disqualification of Consultants

Consultant Contract Services Unit will be posting the list of firms that are on disqualified status on the CCS Website to avoid situations resulting in unfair disqualification of the prime consultant when the prime consultant is teaming up with sub-consultants. All Qualification Statements submitted to DOTD will be considered non-responsive when firms/teams (prime consultants or sub-consultants) are on the List of Disqualified Consultants at the time the Consultant Evaluation Committee meets to discuss the final rating of all firms responding to an advertisement. The following procedures will be followed to place a firm on the List of Disqualified Consultants.

1. A detailed letter of Justification for disqualification from the Section Head through the Division Head to the Chief Engineer for approval.

2. The Section Head’s letter will be forwarded to Consultant Contract Services Unit for filing and posting on the CCS Website after approval by the Chief Engineer.

The following procedures will be followed to remove a firm from the List of
Disqualified Consultants.

1. A letter from the Consultant to the Section Head stating that all contractual obligations have been met by the consultant and requesting the removal of the Consultant from the list.

2. A letter from the Section Head through the Division Head to the Chief Engineer for approval stating that all contractual obligations have been met by the consultant and requesting the removal of the Consultant from the list.

3. The Section Head’s letter will be forwarded to Consultant Contract Services Unit for filing and posting the removal on the CCS Website after approval by the Chief Engineer.
